1. Area of responsibility of the Service Provider
Problems with the operating system or any software installed on the virtual server by the Client are the Client’s responsibility. Problems with host machines and connections are the Company’s responsibility.
2. Rights and obligations of the Service Provider
The Company provides technical support services to clients based on the Client’s request through the personal account at the rates published on the Company’s official website, located at okiha.com The Company is not responsible for the operation of third-party software on the Company’s servers, including software purchased from the Company. The Company’s services are provided “as is.” The Company reserves the right to revise the terms of service, including pricing and tariffs, at any time, without prior notice and unilaterally. New rules come into effect upon publication on the Company’s official website. The Company undertakes to maintain the proper quality of host machines and resolve any malfunctions as quickly as possible. The Company does not guarantee 100% availability of the network and host machines. All scheduled maintenance, updates, and similar activities are conducted from 4:00 AM to 10:00 AM Moscow time. This clause does not apply to force majeure situations and unscheduled maintenance. The Company is not responsible for inability to access services due to the fault of third parties. The Company reserves the right to interrupt the Client’s services and servers for scheduled maintenance, DoS and network attacks, natural disasters, and other force majeure circumstances. The Company reserves the right to increase or decrease prices for services, but notifies the Client in advance via email.
3. Rights and obligations of the Client
If the Client’s hosting is blocked due to a complaint and/or for other reasons 1 (one) or more times per month (network scans, outgoing DoS attacks, etc.) and the Client fails to respond to the complaint, the Company reserves the right to terminate the service early and block the Client without the possibility of a refund. The Client has the right to use their Hosting for any purpose, except for purposes that violate Russian Federation law and copyright and related rights laws. The Client is granted access (unless otherwise agreed) to the server and bears all associated liability. The Client has the right to install and use any software on their server, provided it is legal and does not violate copyright and related rights, or the current legislation of the Russian Federation. The Client is obligated to ensure that all posted materials and software used comply with the content hosted on the server and is responsible for its compliance with the current legislation of the Russian Federation. All questions related to the Client’s hosting performance are accepted only in support requests in the personal account at https://ac.okiha.com
5. Prohibited content and software
In the event of a heavy internet load, the provider reserves the right to unilaterally change the client’s server IP address, unless otherwise agreed upon. Bulk emailing is prohibited, except in cases authorized by the Company. Posting information or software that violates and/or is prohibited by Russian law, including copyright and related rights laws, is prohibited. Posting software for botnets, grabbing, phishing, or other purposes that clearly contradict legal internet use is prohibited. Posting services (including those with paid or private access) that could serve as auxiliary means for illegal activities on the internet is prohibited. Posting pornography, including links and advertisements containing pornographic scenes, is prohibited on the Hosting Service. Posting network scanners, proxy checkers, and similar software is prohibited.
6. Termination of services at the initiative of the Company
The service provider reserves the right to terminate the provision of services at its sole discretion, immediately and without notice in the event of:
Providing knowingly false information about the Client or refusing to confirm it; Slander, dissemination of personal information, violation of copyright and related rights, intellectual property rights; Unauthorized distribution or copying of software protected by copyright, violation of the laws of the Russian Federation, other international norms and agreements, export restrictions, fraud, trafficking in pornographic materials, drugs and other illegal activities; Mass mailings of Spam using the Contractor’s equipment, while Spam is not limited to electronic mailing of letters and includes other generally accepted interpretations on the Internet; Posting pornographic content in all its manifestations, including links to other sites with pornographic content; Violation of privacy and property rights; posting slanderous and offensive information, aiding and abetting ethnic hatred, murder, terrorism, violence in any form; Obstruction of the normal and stable operation of servers, network resources, the general work of the Company; Inappropriate communication with the Company’s employees, including the use of obscene language and the dissemination of defamatory information about the Company;
The Company reserves the right to disclose information about the Client in the event of an official request from law enforcement agencies.
7. The service provider shall not be liable
The Company does not audit the Client’s Hosting content, except in cases of a substantiated complaint from a third party. The Company is not responsible for the Client’s choice of operating system or software and any consequences thereof. It is not responsible for any direct or indirect damages, loss of information, business reputation, or other losses.
*Payment by the Client for the Company’s services is considered full and unconditional acceptance of the terms of this document (acceptance). And payments are non refundable.
